Robert Karrass, mediator and arbitrator

Robert is a senior litigator, mediator and arbitrator who has spent his career working through disputes as an advocate, as a neutral, and as an adjudicator.

As senior litigation counsel Robert represented clients at all levels of court in Ontario and before a range of administrative tribunals. His practice spans corporate and commercial, contractual, and shareholder disputes, employment matters, and other complex and often multi-party civil proceedings.

Robert has also acted as litigation counsel for a number of personal injury firms and is frequently brought in on matters that require intensive litigation, trial preparation or a path forward when a case is not resolving through the settlement process. That work has given him a practical understanding of how litigation risk, evidentiary issues and case strategy influence both the assessment of a case and the prospects for resolution.

Robert has acted as a mediator since 2012 in corporate, commercial, civil, employment, insurance and personal injury disputes, including complex multi-party mediations involving significant legal, commercial and interpersonal issues. He is a member of the Alternative Dispute Resolution Institute of Ontario (ADRIO) and the Alternative Dispute Resolution Institute of Canada (ADRIC), and is included on their mediation and arbitration rosters.

He also brings the perspective of a decision-maker. As a former adjudicator with an Ontario administrative tribunal, Robert has presided over more than 400 hearings, managing proceedings, ruling on contested evidentiary and procedural issues, assessing evidence and testimony, and delivering reasoned decisions. That experience has required him to assess competing positions impartially and has given him firsthand insight into how arguments, evidence and credibility are ultimately received by decision-makers.

It is this combination, advocate, mediator and adjudicator, that informs Robert’s approach to dispute resolution. Having argued cases as counsel, conducted mediations as a neutral and decided contested matters as an adjudicator, he understands a dispute from each of those perspectives. He draws on that experience to identify the issues that matter, test the positions that divide the parties and help move difficult disputes toward resolution.
